Welcome to CodingBugLabs ("we," "our," or "us"), owned and operated by TheMarketBug LLC d/b/a CodingBugLabs. By accessing or using any of our services including BugCanvas, BugTune, or BugVoice (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Description of Services

CodingBugLabs provides AI-powered content generation services:

• BugCanvas: AI-powered image generation platform for creating images from text prompts
• BugTune: AI-powered music generation platform for creating original music compositions
• BugVoice: AI-powered text-to-speech service with voice cloning capabilities

Our services use machine learning models to generate unique content based on your inputs.

3. Account Responsibilities

3.1 Account Creation

To use our Services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Usage Quotas and Generations

Free accounts are subject to monthly generation quotas. Paid accounts receive a monthly allocation of generations based on their subscription tier. Generations are consumed when creating images. Once you exceed your quota, you must wait until the next billing period or upgrade your plan to continue generating content.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

4. User Content and Intellectual Property

4.1 Your Content

You retain ownership of any content you provide to the service, including text prompts, lyrics, uploaded images, reference audio, and other inputs. By submitting content, you grant us a license to use, process, and store it solely for the purpose of providing the Services.

4.2 Generated Content

You own the content generated through your account. This includes the right to use, modify, distribute, and monetize the generated content for any purpose, commercial or otherwise. However, you may not use our service to generate content that infringes on existing copyrights, trademarks, or other intellectual property rights.

4.3 Public Sharing

By default, your generated content may be visible to other users of the platform depending on your account settings. When you share content publicly, you grant other users the right to view and use your generated content according to the platform's sharing settings. You may choose to make content private through your account settings.

4.4 Copyright Infringement

You agree not to use our service to generate content that copies or substantially mimics existing copyrighted works. We reserve the right to remove content that we believe infringes on third-party intellectual property rights.

5. Acceptable Use Policy

You agree NOT to:

• Use the service for any illegal or unauthorized purpose
• Generate content that is hateful, discriminatory, harassing, or harmful
• Create deepfakes, misleading content, or deceptive media of any kind
• Impersonate individuals without their consent
• Attempt to circumvent usage quotas, limitations, or security measures
• Reverse engineer, decompile, or attempt to extract our AI models
• Use automated tools, bots, or scripts to abuse the service
• Share your account credentials with others or allow others to use your account
• Interfere with or disrupt the service or servers
• Upload viruses, malware, or other harmful code
• Use the service to create synthetic media that could deceive or mislead viewers about the authenticity of the content

6. Payment and Subscription Terms

6.1 Subscriptions and Payments

Our service operates on a subscription-based system with monthly generation allocations. Subscriptions can be purchased through our payment processor (Stripe). All sales are final unless required by law. Subscription plans automatically renew unless cancelled.

6.2 Cancellation

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. No partial refunds are provided for unused time or unused generations.

6.2.1 7-Day Money-Back Guarantee

If you're not satisfied with your subscription, you may request a full refund within 7 days of your initial subscription purchase. To request a refund, use the "Request Refund" button on the pricing page. This guarantee applies only to your first subscription purchase.

6.3 Price Changes

We reserve the right to change our pricing at any time. Price changes will not affect existing subscriptions until the next renewal period.

7. Service Availability and Modifications

We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free. We reserve the right to modify, suspend, or discontinue any Service at any time with or without notice. We may also update or modify our AI models, which may affect the style or quality of generated content.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE QUALITY OF GENERATED CONTENT MAY VARY AND IS NOT GUARANTEED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEMARKETBUG LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES.

10. Indemnification

You agree to indemnify and hold harmless TheMarketBug LLC from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or share through the Services

11. DMCA and Copyright Policy

We respect the intellectual property rights of others. If you believe your copyright has been infringed, please notify us at support@codingbuglabs.com with:

• Your physical or electronic signature
• Identification of the copyrighted work
• Identification of the infringing material and its location
• Your contact information
• A statement of good faith belief that the use is not authorized
• A statement that the information is accurate and you are authorized to act on behalf of the copyright owner

We will respond to valid DMCA requests by removing or disabling access to infringing content. Repeat infringers may have their accounts terminated.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Wyoming, without regard to conflict of law provisions. Any disputes arising under these Terms shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. General Provisions

13.1 Entire Agreement

These Terms constitute the entire agreement between you and TheMarketBug LLC regarding the use of the Services.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. Continued use of the Services after changes constitutes acceptance of the new Terms.
